Renewal Conditions
To renew their franchise agreement, Workout Anytime franchisees must provide written notice of their desire to renew between 6 and 12 months before the current term ends. They must be in substantial compliance with their Franchise Agreement and System standards, as well as their lease and vendor agreements. Franchisees are required to complete any necessary facility upgrades, execute a general release of claims against Workout Anytime, complete any additional required training, and pay a renewal fee equal to 75% of the then-current Initial Franchise Fee. The new agreement may contain materially different terms.

Workout Anytime provides several forms of assistance to its franchisees. Before a club opens, it offers a protected territory, site selection guidelines (with optional on-site evaluations for a fee), specifications for fitness and other required equipment, access to an electronic operations manual, initial training for the franchisee and manager, and help with marketing plans. During operation, Workout Anytime provides ongoing marketing plan assistance, periodic visits from its representatives with written reports, advertising and promotional materials, specifications for equipment and supplies, and guidance for equipment orders. The franchisor also makes commercially reasonable efforts to negotiate favorable prices with major suppliers. Additionally, Workout Anytime offers ongoing operational and training assistance upon request, provides consultation via phone and email, develops new products and service methods, assists with general market research and pricing, and maintains a website with individual club pages.
