Renewal Conditions
Wingate by Wyndham franchisees do not have an automatic right to renew their franchise agreement. However, if Wingate Inns International, Inc. and the franchisee mutually agree to renew, the franchisee must apply for a renewal between six and nine months before the current agreement expires. The franchisee will then be required to sign Wingate's then-current franchise agreement, which could have significantly different terms and conditions. Wingate by Wyndham franchises are assigned a "Protected Territory" where Wingate Inns International, Inc. will not own, operate, manage, franchise, or license another Wingate by Wyndham facility without the franchisee's consent. This protected territory may overlap with territories granted to other Wingate by Wyndham facilities. The specific size and boundaries of the Protected Territory are negotiated between the franchisor and the franchisee before signing the Franchise Agreement.
