Renewal Conditions

To renew their WHICH WICH® franchise, franchisees must notify Which Wich Franchise, Inc. of their intent to renew 12 to 24 months before the current term expires. They must be in good standing, having complied with all material terms of their existing agreement, and all monetary obligations to Which Wich Franchise, Inc., its affiliates, suppliers, and landlord must be paid. The store premises must be renovated to meet Which Wich Franchise, Inc.'s then-current image, trade dress, equipment, and furnishings standards. Franchisees must have the right to remain in possession of the store premises or secure an approved alternative site, meet current qualifications and training requirements, and pay a renewal fee. Additionally, the franchisee and each owner must sign a new franchise agreement, which may have materially different terms, and execute a general release of claims in favor of Which Wich Franchise, Inc. and its affiliates.

For a single store, the franchisee operates from an approved, site-specific location, and no territorial rights are granted. For multi-unit development agreements, franchisees may be granted 'limited territorial protection' which is also site-specific and expires once the store opens for business. The franchisor retains the right to develop company-owned or other franchised stores (including those under different names or marks) in any location, even near a franchisee's store. This includes developing in 'Captive Markets' (such as malls, airports, hospitals, universities, stadiums, etc.) regardless of proximity or whether these are within a protected development area. Which Wich Franchise, Inc. does not define territories by specific geographic measurements, population counts, or other measurable criteria; the protection is site-specific and temporary.

Staffing Notes

Which Wich Franchise, Inc. requires the franchised business to be supervised on-premises by an Operating Principal.
