Renewal Conditions

To renew their VaVia franchise, franchisees must be in compliance with the terms of their Franchise Agreement, provide VaVia, LLC with 180 days prior written notice of their request to renew, and sign VaVia, LLC's then-current form of Franchise Agreement and related agreements for the renewal term. They must also sign a general release in favor of VaVia, LLC, pay a renewal fee, and meet all other renewal requirements outlined in the Franchise Agreement. Furthermore, all owners and their spouses must be in compliance with their agreements with VaVia, LLC, including the Owner and Spouse Agreement and Guaranty, and must personally guarantee the terms of the new renewal Franchise Agreement, which may contain terms materially different from their current agreement.

VaVia, LLC provides several forms of assistance to its franchisees. Before opening, VaVia, LLC grants the franchise, reviews and approves the operating territory, provides access to its confidential operations manuals, and offers lists of approved suppliers, signs, equipment, furniture, and fixtures. It also lists the franchisee's business on its website and provides initial training for the managing owner and one designated manager. After opening, VaVia, LLC communicates operating standards, marketing standards, and approved vendors, and may coordinate an annual system conference. VaVia, LLC may also offer supplemental on-site training if requested or required due to performance issues, with an additional fee for replacement managers or specific supplemental training.

Territory Size Requirements

Each VaVia territory generally consists of a geographic area with a population of approximately 300,000 people. Franchisees can purchase additional territories, each also comprising about 300,000 people, or add additional individuals to their operating territory for a supplemental fee. Population is calculated based on raw data without considering demographics or age.

Staffing Notes

VaVia franchisees are solely responsible for managing and supervising their employees, as VaVia, LLC does not provide direct assistance with hiring or training staff. Franchisees are required to ensure that all employees wear approved VaVia branded uniforms and maintain System Supplies and Approved Services and Products according to VaVia standards. The franchise agreement mandates that the managing owner or an approved manager dedicate full-time efforts to the daily management and supervision of the VaVia business. Any appointed manager must complete VaVia, LLC's initial training program and meet specific criteria.
