Litigation Summary
Toastique Holdings, LLC is involved in two legal disputes, both filed on December 27, 2024. In the first case, Toastique Holdings, LLC filed a complaint against a former franchisee, C & G Restaurant Holdings, Inc., and its principals. Toastique Holdings, LLC is seeking a temporary restraining order to prevent the former franchisee from operating a competing business and harming the Toastique brand. The complaint also aims to enforce non-competition provisions in the Franchise Agreement and to stay arbitration related to this action. In the second case, the former franchisee, C & G Restaurant Holdings, Inc., filed a demand for arbitration against Toastique Holdings LLC and several individuals, including Brianna Keefe, George "Kyle" Izett, Sean Keefe, and Julia Berman. This demand alleges fraud, fraudulent misrepresentation, breach of contract, breach of the covenant of good faith and fair dealing, and a violation of the Nevada Deceptive Trade Practice Act, all related to the sale of a franchised business. Toastique Holdings, LLC denies all these allegations and has requested the court to issue an injunction against C & G and to stay the arbitration proceedings.
