Renewal Conditions

To renew their Skyhawks franchise agreement, franchisees must notify Skyhawks Franchise Group, LLC between 7 and 12 months before the initial term ends. They must be in good standing, free from any defaults under the current agreement, pay a successor franchise fee equal to 15% of the original initial franchise fee, and meet the then-current standards that Skyhawks Franchise Group, LLC requires for new franchisees. Upon renewal, franchisees will sign a new franchise agreement and other related documents, which may have materially different terms and conditions, potentially including higher royalty and advertising contributions. Franchisees and their owners must also sign a general release of any known and unknown claims against Skyhawks Franchise Group, LLC and its affiliates.

Before opening their Skyhawks Business, Skyhawks Franchise Group, LLC provides assistance with territory approval, access to the electronic Franchise Operations Manual, initial training, and an initial consultation with an approved CPA for accounting setup. In densely populated metropolitan areas, the territory size may be smaller, whereas less densely populated urban areas may have larger territories.

Staffing Notes

Skyhawks Franchises must be managed by the franchisee, or if the franchisee is an entity, by a managing owner who is a natural person with at least a 51% ownership interest and voting power in the entity. The franchisor also permits the appointment of a designated manager to run the day-to-day operations. Both the managing owner and any designated manager must successfully complete the franchisor's Initial Training Program. If a managing owner or designated manager is replaced, the new individual must also complete this training at the franchisee's expense. All Skyhawks Programs must be staffed with Skyhawks certified directors and coaches. Directors serve as the on-site supervisor for each program, while coaches work individually with participants to teach, encourage, and challenge them. All directors and coaches must successfully complete the certified coach training program before conducting any Skyhawks Program. Franchisees are solely responsible for hiring, training, directing, scheduling, supervising, and disciplining their employees and independent contractors, and for complying with all workplace laws, including wage and hour requirements. The franchisor does not have the power to hire or fire the franchisee's employees. Any advice received from the franchisor regarding employment policies should be considered as examples, and franchisees are responsible for establishing their own policies in consultation with local legal counsel.
