Litigation Summary
Relive Franchising LLC has been involved in three legal matters. In March 2024, Relive Franchising LLC entered into a Consent Order with the Maryland Securities Division after self-reporting the sale of an unregistered franchise and area representative franchise in Maryland. As a result, Relive paid a $7,500 civil penalty and notified its Maryland area representative about a potential private right of action. Also in March 2024, Relive Franchising LLC settled claims with the Minnesota Commerce Department, agreeing to pay $1,000 in investigative costs and offer rescission to a Minnesota franchisee, after selling franchises when its disclosure document was not registered in the state. Additionally, in April 2023, Relive Franchising LLC, along with DJI Consulting LLC, filed a lawsuit against Fit Medical Management, Inc., operators of a formerly corporate-owned location, for breach of contract and trademark infringement after the operators continued using the R3VIVE service mark despite agreement termination. Fit Medical Management, Inc. counter-sued, claiming it was an accidental franchisee and alleging violations of the New York Franchise Sales Act, fraudulent representation, and breach of contract. The parties reached a confidential settlement in November 2023, where DJI agreed to pay Fit Medical Management, Inc. $375,000, and all related actions were dismissed with prejudice.
