Radiant Waxing has a limited legal history. There is one pending lawsuit and one completed legal matter involving its predecessors. The pending case, filed in October 2023, is Kathleen Martin et al. v. Radiant Waxing Franchise, LLC, WellBiz Brands, Inc., Steele Pomp LLC, Lunchbox Franchise, LLC, and Jeremy Morgan. This lawsuit was brought by a group of franchisees who allege breach of franchise agreements, tort claims, equitable claims, and a consumer protection act claim. In April 2017, Aesthetica, LLC filed a lawsuit against Lunchbox, LLC and a franchisee, alleging trademark infringement, unfair competition, deceptive trade practices, and intentional interference. Aesthetica also filed petitions with the Trademark Trial and Appeal Board to cancel several Lunchbox trademarks. In July 2017, Lunchbox, LLC assigned the marks to Lunchboxwax Holdings. The parties reached a settlement in April 2020 where Aesthetica withdrew its petitions, assigned certain marks to Lunchboxwax Holdings, and received a non-exclusive license and consulting agreement. Both parties dismissed their litigation and released all claims.

Renewal Conditions
To renew their franchise agreement for an additional 10-year term, Radiant Waxing franchisees must meet several conditions. They and their owners must have substantially complied with the existing franchise agreement during its term and be in full compliance at the time of notice and renewal. Franchisees must maintain possession of their salon and agree to remodel or expand it, replace improvements and operating assets, and modify it to meet the then-current standards for new Radiant Waxing salons. Alternatively, they can secure and develop new premises approved by Radiant Waxing. Franchisees must also sign the then-current form of franchise agreement (which may have different terms), sign a general release of claims against Radiant Waxing, and pay a successor franchise fee equal to 25% of the then-current initial franchise fee for new franchises.

Radiant Waxing provides comprehensive assistance to its franchisees. Before opening, Radiant Waxing helps with site selection and lease approval, provides mandatory and suggested specifications for salon development and construction, grants access to the operations manual, and offers an initial training program. After opening, Radiant Waxing may offer general guidance based on reports and inspections, administers a brand marketing fund, and may set maximum or minimum advertised prices for services. Radiant Waxing provides a training team for 5 to 7 days before opening a new salon and an operations team for 3 to 6 days. For existing salons acquired through transfer, virtual advice and guidance are provided, with an optional 3-day on-site training team. Additional or special training is available upon request for a fee. Franchisees are also required to attend annual conferences and regional meetings.

Ongoing Support
Radiant Waxing provides ongoing support to its franchisees after they open. Franchisees and their managers are required to attend annual franchise owner conferences and may also be required to attend regional meetings, in-person or electronic training courses, trade shows, ongoing education programs, and webinars. A manager training program is offered, but not currently required. Radiant Waxing also reserves the right to conduct periodic, unannounced visits to evaluate salons.

Radiant Waxing typically defines a franchisee's Protected Area as a circular geographic area with a 1.5-mile radius, centered at the front door of the salon. In densely populated urban areas, the Protected Area may be defined by political subdivisions, streets, or ZIP codes, and could be the lesser of a 1.5-mile radius or a circle reflecting a 50,000-person population density. These boundaries are determined on a case-by-case basis using factors like population, traffic, and proximity to other businesses and residential areas.
Staffing Notes
Radiant Waxing franchisees are solely responsible for all decisions regarding their employees, agents, and independent contractors, including hiring, training, compensation, and work schedules, in compliance with all employment laws. Franchisees must perform background checks for all employees and update them as specified in the Operations Manual. All waxologists must obtain and maintain the appropriate credentials required by law and have adequate professional liability insurance. Each salon is required to hire and maintain at least one full-time waxologist per suite and a Waxologist Trainer who has completed the Radiant Waxing Waxologist Trainer program. Waxologists must also complete specific on-site training (approximately 113 hours over 90 days) facilitated by the Waxologist Trainer before performing services. Radiant Waxing may periodically modify staffing-related System Standards and job positions.
