Renewal Conditions

To renew their Premier Pools & Spas franchise for a successor term of five years, franchisees must provide written notice between 3 to 6 months before their current agreement expires. They are required to upgrade their business, including vehicles, office, and equipment, to align with the current mandatory System Standards for new System Businesses. Franchisees must pay a successor franchise fee equivalent to 50% of the then-current initial franchise fee. Additionally, they must be in good standing, meaning they are not in default of their franchise agreement or any other agreements with Premier Pools & Spas or its affiliates, and must have substantially complied with all provisions and Minimum Annual Performance Requirements for their Pool Types during the 12 months preceding the renewal request. Franchisees must also sign the franchisor's then-current standard franchise agreement, which may contain terms materially different and potentially less favorable than their original contract, and satisfy all current qualification and training requirements. Finally, franchisees and their owners must execute a general release of all claims against Premier Pools & Spas and its affiliates.

Premier Pools & Spas provides comprehensive assistance to its franchisees. Before opening, the franchisor offers electronic access to its Manual, an initial training program for the franchisee and their representatives, and reviews and approves proposed business sites and leases. For commercial spaces, prototype design and layout plans are provided. Premier Pools & Spas also supplies lists of required items, services, and approved suppliers, and helps develop a first-year marketing plan. Ongoing support includes continuous consultation regarding operations and timely notifications of changes in System Standards. The franchisor provides marketing materials, with initial supplies free of charge. Premier Pools & Spas also manages Marketing Programs, funded by franchisee marketing fees, with full discretion over their implementation. The franchisor or its designees may establish a System Website for network promotion and operations, requiring franchisee participation and compliance with related standards. Franchisees are expected to comply with social media policies and may be offered participation in 'Special Account' agreements for multi-market customers. Franchisees must also acquire and maintain specified computer and communication equipment, software, and services, and are subject to periodic upgrades.
