Renewal Conditions

To renew their Lush Lawn franchise, franchisees and their affiliates must not be in default of any agreements with Lush Lawn Franchising, nor have received two or more notices of default within the last 12 months. They must provide timely written notice of intent to renew, and prove they can maintain possession of an approved Franchise Location, or secure a suitable alternative within their Designated Area. Franchisees must also bring the business into compliance with current appearance, equipment, and signage standards, including potential refurbishment of the location and replacement of vehicles (before they are 10 years old). All material reporting and monetary obligations to Lush Lawn Franchising, its affiliates, suppliers, and creditors must be satisfied. Franchisees must complete any additional required training, sign a general release, sign the then-current standard Franchise Agreement (which may have materially different terms), and pay a renewal fee. Finally, Lush Lawn Franchising must approve the renewal, which will not be unreasonably withheld.

Before opening, Lush Lawn Franchising will review and approve the franchisee's office/storage location and lease, establish territory boundaries, and provide specifications for equipment, fixtures, signs, inventory, and other necessary products and services. Lush Lawn Franchising also provides access to its Brand Standards Manual, an initial training program for up to two people (including one Designated Owner and one General Manager), and one representative for up to two days to assist with the initial operation. It also guides on product and service pricing and reviews plans for initial launch marketing. During operation, Lush Lawn Franchising continually updates the Brand Standards Manual and specifications for Approved Products and Services. It provides ongoing training, periodically visits the franchised business to evaluate operations and offer advice, and administers the Brand Development Fund. Lush Lawn Franchising also makes uniform modifications to its Intellectual Property and reviews alternative locations if the initial one becomes unusable.

Each Lush Lawn franchise territory, known as the Designated Area, is defined to contain a minimum of 80,000 detached, single-family homes with a median household income of $75,000 or above.

Staffing Notes

Lush Lawn Franchising requires the franchised business to always be supervised by a General Manager who devotes full-time effort to day-to-day active management, is personally responsible for the business, and actively markets it to maximize customer satisfaction. Franchisees are responsible for hiring, training, and maintaining a competent and conscientious staff that complies with all operational standards and completes all specified training programs.
