Renewal Conditions

To renew their franchise agreement, Kampgrounds of America, Inc. (KOA) franchisees must be in full compliance with their existing Franchise Agreement and provide KOA with written notice of their intent to renew. They are required to upgrade their campground business to meet KOA's then-current standards and fulfill all monetary obligations. Franchisees must sign a general release and provide evidence of maintaining property control for the renewal term. They also need to execute KOA's then-current franchise agreement, which may contain materially different terms and conditions, including potential changes to the protected territory. Additionally, neither the franchisee nor any of their affiliates may own or operate another recreational vehicle park or campground business under a brand other than KOA. A Renewal Expiration Fee of $7,500 is also required if KOA permits renewal after the agreement's expiration.

Post-opening, KOA offers training at KOA University, field support services, information on equipment and supply pricing, distribution of the annual KOA Campgrounds Directory, and maintenance of its technology systems. KOA also collaborates with manufacturers and suppliers to promote camping and inspects campgrounds for compliance with standards, while managing the Advertising Fund.

Generally, KOA grants a minimum territory defined as a 1-mile radius surrounding the campground.

(KOA) franchisees are responsible for recruiting, hiring, and training all employees for their campground business, including determining employment terms, compensation, and work schedules. KOA franchisees are also solely responsible for employee supervision, maintaining employment records, and handling discipline or termination. They must clearly notify employees that they are employed by the franchisee, not KOA, and are responsible for administrative functions like payroll and workers' compensation insurance. If the franchisee chooses not to personally operate the campground, it must be overseen by an on-premises manager who successfully completes KOA's initial training program within their first 12 months of employment.
