Crepe Delicious Holding USA, Inc. requires its franchisees to hire and supervise efficient, competent, and courteous employees for the operation of their Crepe de licious Business. Franchisees are responsible for ensuring all employees work in clean, franchisor-approved uniforms, which can be furnished at the franchisee's or employee's cost. The franchisee holds sole responsibility for all employment decisions and functions, including hiring, firing, training, remuneration, compliance with wage and hour requirements, safety, work conditions, assignments, taxes, schedules, personnel policies, benefits, recordkeeping, supervision, and discipline of employees, regardless of any advice received from Crepe Delicious Holding USA, Inc. Employees are considered solely employees of the franchisee and not of Crepe Delicious Holding USA, Inc., which must be communicated to all employees and contractors. Franchisees may be required to have employees sign an employment relationship acknowledgment form. Franchisees must use their legal name on all employee-related documents and refrain from using the Crepe Delicious Marks on these documents. A conspicuous notice explaining that employees are employed by the franchisee and not by Crepe Delicious Holding USA, Inc. must also be posted. The Crepe de licious Business must be managed by the franchisee or, if the franchisee is an entity, by an owner with at least a 25% ownership interest and voting power (referred to as a "Managing Owner"), unless the franchisee is participating in a Management Program. Under certain circumstances, Crepe Delicious Holding USA, Inc. may permit the franchisee to appoint a designated manager (a "Designated Manager") to oversee day-to-day operations. This Designated Manager must meet Crepe Delicious Holding USA, Inc.'s standards for educational, managerial, and business experience and successfully complete its initial training program. Crepe Delicious Holding USA, Inc. may also require the Designated Manager to hold an ownership interest in the franchisee entity. If a Designated Manager is replaced, the new manager must satisfactorily complete the initial training program at the franchisee's expense. Designated Managers must also sign confidentiality and system protection agreements, and other employees may be required to sign similar agreements. The franchisee and their initial Designated Manager must complete an initial training program at least two weeks before opening, provided at no charge for up to three people. Additional attendees incur a $2,000 fee plus expenses. If a Designated Manager fails training, they may be required to attend additional training or be replaced.
