Litigation Summary
BATH TUNE-UP® has disclosed four legal actions. Three cases are recent. In 2023, a former franchisee's guarantor, Brian J. Hill, filed for Chapter 7 bankruptcy. BATH TUNE-UP® initiated a proceeding to challenge the discharge of certain debts, which was settled, and the settlement amount was deemed non-dischargeable. Also in 2023, BATH TUNE-UP® filed a lawsuit and later arbitration against former franchisee Orange Diamond Remodeling Solutions, LLC and its guarantors for breach of contract and non-payment. The guarantors subsequently filed for Chapter 7 bankruptcy, leading BATH TUNE-UP® to dismiss the arbitration and lawsuit without prejudice after their debts were discharged. In 2024, BATH TUNE-UP® filed a lawsuit against another former franchisee, Fillmore Enterprises, Inc., to recover outstanding amounts owed under the franchise agreement. Additionally, an affiliate, Aussie Pet Mobile, Inc. (under previous ownership), entered a consent order with Maryland's Securities Division in 2006, requiring it to cease offering franchises in violation of state law, rescind a franchise agreement, and represent that other franchisees received proper disclosure.

Before opening, BATH TUNE-UP® assists franchisees by designating their territory and allowing them to use the brand's trademarks. They provide an initial training program (combining virtual and in-person instruction) along with a 'Startup Package' and proprietary information for staff training, including electronic access to manuals. The franchisor also provides a list of standard equipment and suggested suppliers, and helps with initial pre-opening and post-opening promotions. A 12-week post-training program and launch team guide franchisees through opening activities. After opening, BATH TUNE-UP® polices its trademarks, offers additional training for new products/services, and makes representatives available for consultation during business hours.
